■TERMS OF SALE

Article 1 - Object

• These General Conditions have as their object the purchase of products and services made remotely via the telematic network on the website WWW.SPEEDCOMFLY.COM owned by Munaro Lucia with registered and operational office at Via Stortoletta, 9 - 35020 Tribano Padova.
• These purchases are reserved for direct consumer customers, excluding subjects such as merchants, wholesalers, resellers, professionals, etc., who intend to resell the products to third parties. Each purchase transaction will be governed by the provisions of Legislative Decree no. 185/99 and, with regard to privacy protection, will be subject to the regulations of Law no. 675/96 and subsequent amendments.

Article 2 - Acceptance of the general sales conditions

• The Customer, by electronically sending the confirmation of their purchase order, unconditionally accepts and undertakes to comply with the general terms and payment conditions set out below, declaring to have read and accepted all the information provided to them in accordance with the aforementioned regulations, and acknowledging that LA BOTTEGA DELL'AQUILONE SPEED COM does not consider itself bound by different conditions unless previously agreed in writing.

Article 3 - Customer commitments

• These General Sales Conditions must be examined online by customers visiting the website WWW.SPEEDCOMFLY.COM before they confirm their purchases. The submission of the order confirmation therefore implies full knowledge of these General Sales Conditions and their full acceptance.
• Once the online purchase procedure is completed, the Customer undertakes to print and retain these general sales conditions, which have already been viewed and accepted during the purchase process, in order to fully satisfy the condition referred to in Articles 3 and 4 of Legislative Decree no. 185/1999.

Article 4 - Purchasing methods

• WWW.SPEEDCOMFLY.COM is a telematic website for the sale of products for ultralight aviation.
• The purchase of available products, as well as their online description and specifications, is made by the Customer at the indicated price, to be confirmed at the time of order confirmation, plus the specified shipping costs, as displayed at the time of purchase.
• Before confirming the purchase, the Customer will be provided with a summary of the unit cost of each selected product, the total cost in case of multiple products, and the shipping costs.
• Upon confirming the purchase to complete the transaction, the Customer will receive an email containing the Order Number, Date, and Total Amount of their order.

ARTICLE 5 - Payments

• · Payment for the purchased products and related shipping costs must be made by the customer via advance bank transfer followed by sending a copy of the same, or directly to the courier in cash upon delivery.
  · In the case of postal shipments, payment accepted by Poste Italiane is cash only.
  
  Payment by bank transfer is subject to the following conditions:
  
  The reason for the bank transfer must indicate: the order number and date, the name and surname of the orderer;

  Payment in cash is subject to the following conditions:
  
  The customer pays the due amount in cash to the postman or chosen courier.
  
  Payment by credit card is subject to the following conditions:
  
  Credit cards can be used for online purchases or at our headquarters. The payment service through the use of PayPal incurs an additional cost of: (cost + 4% on the total including shipping costs).
   

  ARTICLE 6 - Product Delivery

  • The purchased products will be delivered via private courier to the address indicated by the Customer, exclusively within the Italian territory. Each shipment is accompanied by an envelope containing the following documentation:
    Invoice or fiscal receipt: for a minimum invoiced amount of 100 euros + VAT. For amounts lower than that, a fiscal receipt will be issued.
    
    Copy of the received order.
  • The reshipment, for any reason, of any of the aforementioned documents will be arranged within three days of the request.
  • The product deliveries will take place during all working days. The fulfillment of orders by LA BOTTEGA DELL'AQUILONE SPEED COM may be divided, without any liability for LA BOTTEGA DELL'AQUILONE SPEED COM.
  • LA BOTTEGA DELL'AQUILONE SPEED COM uses the following carriers for product delivery:
  • CORRIERE ESPRESSO GLS EXECUTIVE: for orders paid on delivery in cash or by authorized check or advance bank transfer. Indicatively, without any binding for LA BOTTEGA DELL'AQUILONE SPEED COM and subject to product availability on the market and any force majeure events, the goods will be delivered to the carrier with the following timing:
  • Corriere GLS ASSICURATO within 24 hours (1 working day) from receipt of payment or cash on delivery order. The products will be delivered by the carrier within the following 24/48 hours (2 working days), except for the islands, for which 72 hours (3 working days) are expected.
  • CORRIERE ESPRESSO GLS EXECUTIVE are covered by insurance.
  • The delivery times are indicative and should be considered valid unless there are physical or structural impediments (e.g., incorrect addresses or particularly adverse weather conditions). The contribution for transportation, to be added to the price of the purchased products, will be automatically calculated by the system based on the weight and volume (total of the products in the shopping cart).
  • The shipped products are contained in cardboard boxes of various sizes, sealed on the top and bottom with personalized adhesive tape.
  • The Customer is required to verify, upon receipt, the conformity of the delivered product in relation to the placed order, as follows:
    The number of packages indicated on the carrier's letter corresponds to the number of packages actually delivered;
    The package is intact, undamaged, and otherwise conforms to the standard characteristics (described above) of a SPEEDCOMFLY.COM package.
  • Only after such verification, the Customer must sign the carrier's letter. After that, no claims can be made regarding the external characteristics of the delivered goods in relation to the placed order. In the case of non-compliance between the order and the delivery, according to the aforementioned procedures, the customer should not accept the goods and raise the claim directly with the carrier.

  Article 7 - Guarantees

  Products purchased through LA BOTTEGA DELL'AQUILONE SPEED COM are subject to the regulations, where applicable, of Legislative Decree No. 24 of February 2, 2002 (Official Gazette No. 57, March 8, 2002) concerning sales contracts and warranties for consumer goods. For matters not covered therein, specific provisions of the Civil Code shall apply. This warranty applies to products that have conformity defects and/or malfunctions that were not identifiable at the time of purchase, provided that the product is used correctly and with due diligence, in accordance with its intended use and the instructions provided in any technical documentation, and in compliance with the applicable operational rules. This warranty shall not apply in case of negligence or improper use and maintenance of the product, connection of the purchased item to electrical systems or any other non-compliant type of connection. The warranty is personal and shall only apply to the original purchaser, as it is reserved for direct customers and not for traders, resellers, etc.

  Article 8 - Right of Cancellation and Withdrawal

  The customer has the right to cancel the order within 24 hours by giving written notice via email to LA BOTTEGA DELL'AQUILONE SPEED COM. If the customer does not act within the specified time and according to the specified procedures, the contract shall be considered concluded. If the customer has already been charged, LA BOTTEGA DELL'AQUILONE SPEED COM will arrange for a refund on the same day. In accordance with Legislative Decree No. 185 of May 22, 1999, the Customer has the right to exercise the right of withdrawal within 10 working days from the receipt of the requested goods. This right applies to all products listed on the website WWW.SPEEDCOMFLY.COM. Furthermore, in accordance with the aforementioned Legislative Decree 185/99, it is specified that the right of withdrawal is exclusively reserved for customers defined as "consumers," namely individuals who purchase products for their own use and not for professional purposes, excluding traders, resellers, professionals, etc.

  Article 9 - Procedure for exercising the Right of Withdrawal

  In order to exercise the right of withdrawal, the Customer must send a registered letter with return receipt, or alternatively, a fax, telegram, or telex communication confirmed by registered letter within 48 hours, to the following address, within the deadline specified in Article 8 of these General Terms and Conditions of Sale:

  Within the next working day, LA BOTTEGA DELL'AQUILONE SPEED COM will communicate to the Customer, via email, the Return Authorization Number (NAR) to be affixed to the merchandise to facilitate the return process.

  LA BOTTEGA DELL'AQUILONE SPEED COM will proceed with transmitting the credit order for the cost of the shipped merchandise within fourteen working days following the shipment of the merchandise by the customer, and in any case, not before receiving the goods. This operation will be carried out by crediting the bank account indicated by the Customer.

  The expenses for returning the goods to the sender, on the other hand, are borne by the Customer. LA BOTTEGA DELL'AQUILONE SPEED COM will consequently reject any product that is returned unpackaged or in any way different from the specified methods, as well as products for which the Customer has not fully paid the return costs.

  LA BOTTEGA DELL'AQUILONE SPEED COM will reject any product in the event that the return costs have not already been fully paid by the customer or if the terms and conditions provided by the law (Article 5 of Legislative Decree 185/99) for communicating the exercise of withdrawal have not been complied with, or if the product has not been packaged with original packaging or is not complete with all accessories, instruction manuals, and everything originally included.

  The replacement of goods for "INCORRECT CUSTOMER ORDER" or for a product variation is possible only within 8 days from the date of invoice or receipt issuance. The returned merchandise for exchange must be in its original packaging and condition, not tampered with or modified, accompanied by the relevant tax documentation. The expenses for sending the merchandise to our location are borne by the customer. The amount is replaced with another product or in the form of a "store credit" minus a WAREHOUSE HANDLING fee equal to 10% of the replaced merchandise. All goods subject to cutting or custom-made processing (such as tubes, ribbons, wires, etc.) are NOT ELIGIBLE FOR REPLACEMENT. THE ABSENCE OF A RECEIPT OR INVOICE THAT CONFIRMS THE PURCHASE NULLIFIES THE POSSIBILITY OF REPLACEMENT.

  Article 10 - Information and Complaints

  Article 11 - Jurisdiction and Competent Court

  This contract will be governed by Italian law. For any dispute regarding the validity, interpretation, or execution of the same contract, the competent court is the one in Padua.
